? Equatorial Resources ( ASX:EQX ) managing director John Welborn says central and west Africa will be the world?s next major supplier of iron ore. Speaking at the Africa Down Under Conference in Perth he said that traditional iron ore regions will struggle to fulfil future Chinese demand. And he told conference goers that even the most sombre forecasters agreed China?s consumption of seaborne iron-ore will continue to grow and that this provides a degree of certainty that projects in central and west Africa would be developed to ?fill the gap?. Welborn?s Equatorial Resources is advancing two large scale iron ore projects in the Republic of Congo. The mining executive pointed to China?s stated ambition for 50 per cent of China?s iron imports to come from Chinese owned mines outside of the country by 2015. ?China remains by far the dominant buyer of seaborne iron-ore, importing more than 650-million tons last calendar year, or 63% of total global seaborne iron-ore demand,? Welborn said. ?Historically, more than 75% of China?s seaborne iron-ore supply has come from Australia, Brazil and India and China recognises it has relied too heavily on the big three producers,? he said. ?Chinese steels mills are suffering from high input costs and low profitability and need to find new sources of supply. NASA completes successful parachute drop simulation of Orion spacecraft

NASA has always used the desert as its own personal playground, and we'd imagine that its team had a blast in Arizona yesterday, as a mock parachute compartment of the Orion spacecraft was dropped from 25,000 feet above Earth. The dart-shaped object experienced free fall for 5,000 feet, at which point, drogue chutes were deployed at 20,000 feet. This was then followed by pilot chutes, which then activated the main chutes. As you'd imagine, these things are monsters: the main parachutes -- three in all -- each measure 116 feet wide and weigh more than 300 pounds. Better yet, the mission was successful.

Naturally, all of this is in preparation for Orion's first test flight -- currently scheduled for 2014 -- where the unmanned craft will travel 15 times further than the ISS and jam through space at 20,000 mph before returning to Earth. Yesterday's outing is merely one in a series of drop tests, and yes, it's important to remove any unknowns from the situation: eventually, humans will be along for the ride.

Who Cares About Hearing When Your Weight Is Down?

My ears are ringing. I feel like a dog being called home by one of those dog whistles. I find myself randomly bounding down the road with a look of curiosity and absolutely no direction.

So, I went to my doctor to see if there?s a pill for that. He told me that I probably have had some slight hearing loss. I said, ?What?? He didn?t find that amusing.

Apparently I attended one Prince concert too many in my youth. Still worth it, though.

The good news is that my?weight was down and I graduated to another category on that insurance chart. Many thanks to hot yoga for that change. Woohoo!

Next, my height. I usually look like Snooki at my physicals because I create a hair-poof to get that extra 1/2 inch, but I forgot to do that yesterday. Nurse Ratchet measured my height, poof-less, and took me down an inch, which threw me back into the original weight category.

I went home and remeasured, and got back to my original height of 5?3?. Now I have to call the doctor?s office and petition to get them to officially change the chart.

If they refuse, I might pull an ?Occupy My Doctor?s Office? and pitch a tent until they do. I will sing bad songs from the sixties and cook my dinner on their sidewalk with my tiny Coleman stove.

Because when you?re dealing with weight charts, one-inch is golden.

As far as my hearing goes, I?m growing fond of the slight whistle in my ears. I pretend it?s a seashell pressed to my head, whispering secrets of the sea.

Plus, I can act like I don?t hear people when they raise a topic I want to avoid. I used this particular skill at the end of the doctor?s visit.

See. You gain a little something with every loss. You just have to be creative.

Lenovo's $399 Android Tablet Has a Detachable Keyboard

Lenovo expanded its Ideatab line of tablets Thursday with the Ideatab S2110, A2107, and A2109. Running Android 4.0 Ice Cream Sandwich, the trio of tablets are both thinner and smarter than the company?s previous offerings, and come with affordable price tags.

At the top of line of tablets sits the Ideatab S2110. The 10-inch tablet is 8.69mm thick and weighs 580g, making it one of the thinnest and lightest tablets on the block.

Much like Microsoft?s upcoming Surface tablet, the Android slate has an optional keyboard dock that can be used for creating a PC-like experience on the device.

In addition to the keys, when the tablet is connected to the keyboard dock you also improve your battery life, giving the tablet the ability to run a whopping 20 hours before you?ll have to search for an outlet. The keyboard dock also brings an SD card reader and USB ports into the mix, allowing you to connect a thumb drive to the tablet or even an external hard drive or house.

On the optics-front the tablet also has a 5-megapixel rear-facing camera for taking pictures, and a 1.3-megapixel forward-facing camera for video chat.

The S2110 is available today for $399.

For the cost-conscious, Lenovo has the A2107 and A2109, a 7-inch and 9-inch tablet respectively. They're designed for customers who are looking to use their tablet for basic consumption such as watching videos, listening to music, or browsing social networking sites.

?The newest line of Ideatab products provides an option for everyone who wants to keep all of their favorite books, songs and movies at their fingertips, no matter where they go,? said Liu Jun, senior vice president, and president, Mobile Internet and Digital Home business.

The 9-inch version of the tablet is available today for $299. The 7-inch version will be available later this year.

Quick Study: The One-Two Punch of Exercise Cuts Disease Risk and Nicotine Cravings

The studies: Two studies released this week show the health benefits of exercise. A study in Archives of Internal Medicine found that among 18,670 people taking part in a long-term study, keeping fit via cardiovascular exercise while in middle age helped reduce their risk of developing a chronic disease. In return for increasing fitness levels by 20 percent, study participants saw a 20 percent drop in their chances of developing diseases such as colon cancer, Alzheimer?s disease and congestive heart failure.

The next time you feel like lighting up, go for a jog instead. Research in the journal Addiction analyzed 19 previous studies looking at the effects of short bouts of exercise on the desire to smoke. Following those exercise stints, people had considerable reductions in cigarette cravings compared to those in control groups who did passive activities.

What we already know: Regular exercise has been shown in countless studies to help promote longevity and reduce the risk of acquiring a number of diseases and conditions, such as Type 2 diabetes, cardiovascular disease, high blood pressure and cancer. Physical benefits of exercise include improved heart health, and mental benefits include declines in depression. It?s thought that exercise?s ability to reduce inflammation in the body may be at least partly responsible for disease protection.

What it means for you: The advantages of physical activity are many, and it?s never too late to start. Exercise doesn?t have to be arduous or boring, and doing as little as 30 minutes a day, five days a week can improve your overall health and quality of life. Walking, running, cycling, dancing, gardening and a pick-up game of basketball all count as ways to keep fit.

From Roth conversions to changes in reporting capital gains and losses, there were a number of tax changes in 2011. Whether you already know about them or simply need a reminder, here?s a look at 10 changes in 2011 that might benefit you, the taxpayer, this tax season.

1. April 17 Tax Deadline: Two Extra Days to File and Pay

Taxpayers across the nation will have until Tuesday, April 17, 2012, to file their 2011 income tax returns and pay any taxes due. Taxpayers have extra time because April 15 falls on Sunday, and Emancipation Day, a holiday in the District of Columbia, is observed the following day on Monday, April 16. By law, filing deadlines that fall on D.C. holidays are extended to the next day that is not a Saturday, Sunday, or holiday.

The April 17 deadline applies to any return or payment normally due on April 15. It also applies to the deadline for requesting a tax-filing extension and for making 2011 IRA contributions. Taxpayers requesting an extension will have until Oct. 15 to file their 2011 tax returns.

2. Tax Credits Extended

Legislation, enacted in December 2010, extended several well loved tax benefits, including the American opportunity credit for parents and students, the enhanced child tax credit and the expanded Earned Income Tax Credit.

3. Limited Non-business Energy Property Credit Still Available

This credit generally equals 10 percent (down from 30 percent the past two years) of what a homeowner spends on eligible energy-saving improvements, up to a maximum tax credit of $ 500 (down from the $ 1,500 combined limit that applied for 2009 and 2010). In addition, the energy standards are increased for most property; windows, exterior doors and skylights, for example, must meet Energy Star Program requirements.

Because of the way the credit is figured, in many cases, it may only be helpful to people who make energy-saving home improvements for the first time in 2011. That?s because homeowners must first subtract any non-business energy property credits claimed on their 2006, 2007, 2009 or 2010 returns before claiming this credit for 2011.

The cost of certain high-efficiency heating and air conditioning systems, water heaters and stoves that burn biomass all qualify, along with labor costs for installing these items. In addition, the cost of energy-efficient windows and skylights, energy-efficient doors, qualifying insulation and certain roofs also qualify for the credit, though the cost of installing these items do not.

4. Repayment of First-Time Homebuyer Credit

Taxpayers who claimed the first-time homebuyer credit for a home bought in 2008 must generally make the second of 15 annual repayment installments on their 2011 return.

Separately, a repayment requirement also applies where a taxpayer bought a home and claimed the credit on a prior year return and then sold it or stopped using it as a main home in 2011.

Though the credit has expired for most home buyers, certain members of the armed forces and some other taxpayers who bought a home early in 2011 may still qualify for the credit on their 2011 return.

5. New Way to Report Capital Gains and Losses

In most cases, taxpayers now use new Form 8949 to report capital gain and loss transactions. Schedule D, the form traditionally used to show these individual transactions, is now used as a summary sheet, reporting amounts for total sales price, basis and other adjustments for all individual transactions, and for figuring the tax. For securities both bought and sold in 2011, the Form 1099-B, issued by the broker, normally shows the taxpayer?s basis.

6. Reporting Roth Conversions

As in 2010, income limits no longer apply to rollovers or conversions to Roth IRAs from other retirement plans. But, unlike 2010 conversions, all of the income resulting from a 2011 conversion must be included on the taxpayer?s 2011 return. For 2010 conversions, only half of the resulting income must be included in income in tax-year 2011 and the other half is reported in 2012, unless the taxpayer chose to include all of it in income for 2010.

7. AMT Exemption Increased

For tax-year 2011, the alternative minimum tax exemption increases to the following levels:

? $ 74,450 for a married couple filing a joint return and qualifying widows and widowers, up from $ 72,450 in 2010.

? $ 37,225 for a married person filing separately, up from $ 36,225.

? $ 48,450 for singles and heads of household, up from $ 47,450.

8. Health Insurance Deduction for Self-Employed Individuals

In 2011, eligible self-employed individuals and S corporation shareholders can use the self-employed health insurance deduction to reduce their income tax liability. Premiums paid for health insurance covering the taxpayer, spouse and dependents generally qualify for this deduction. In addition, premiums paid to cover an adult child under age 27 at the end of the year, also qualify, even if the child is not the taxpayer?s dependent. But, the deduction from self-employment income for determining self-employment tax, which was available only in tax-year 2010, no longer applies.

As before, the insurance plot must be set up under the taxpayer?s business, and the taxpayer cannot be eligible to participate in an employer-sponsored health plot.

9. Change for HSAs and MSAs

Starting in 2011, the additional tax on distributions from a health savings account (HSA), not used for qualified medical expenses, increases from 10 percent to 20 percent. Report on Form 8889. Similarly, the additional tax on distributions from an Archer medical savings account (MSA), not used for qualified medical expenses, rises from 15 percent to 20 percent.

10. New Form for Reporting Foreign Financial Assets

Taxpayers must report specified foreign financial assets on new Form 8938, if the aggregate value of those assets exceeds certain thresholds. This new requirement is designed to improve tax compliance by taxpayers with offshore financial assets. Form 8938 is separate from and does not replace the existing requirement that U.S. persons with financial accounts located in a foreign country report those accounts to the Treasury Department using Form TD F 90-22.1. Unlike Form TD F 90-22.1, Form 8938 is attached to a taxpayer?s income tax return. Individuals who do not have an income tax return filing requirement need not file Form 8938.

The Form 8938 filing requirement applies to U.S. citizens and resident aliens, nonresident aliens who elect to file a joint income tax return and certain nonresidents who live in a U.S. territory. Form 8938 is required when the total value of specified foreign assets exceeds certain thresholds. For example, a married couple living in the U.S. and filing a joint tax return would only file Form 8938 if their total specified foreign assets exceed $ 100,000 on the last day of the tax year or more than $ 150,000 at any time during the tax year.

The thresholds for taxpayers who live abroad are higher. For example, a married couple living abroad and filing a joint return would file Form 8938 if the value of specified foreign assets exceeds $ 400,000 on the last day of the tax year or more than $ 600,000 at any time during the year.

Mayo Clinic marks its first births from time-lapse incubator use for in vitro fertilization

ScienceDaily (Aug. 29, 2012) ? Mayo Clinic recently marked its first births resulting from in vitro fertilization using a new time-lapse incubator that minimizes disturbances from human handling as embryos develop and helps fertility specialists better identify the healthiest embryos. Mayo experts say it may improve pregnancy outcomes for all patients receiving IVF.

The twins born at Mayo and babies delivered at the Fertility Centers of New England (http://www.fertilitycenter.com/) mark the first reported births in the United States using the technology.

Millions of women in the United States have difficulty becoming pregnant or staying pregnant. Many seek medical help. One of the most common procedures is IVF, in which mature eggs are retrieved from a woman's ovaries and fertilized by sperm in a lab. Embryos are then transferred into the uterus. IVF is highly effective, but typically requires periodic handling of embryos for observation outside of the incubator.

"With current technology, IVF is successful for many patients; however, we believe it can be improved even further," said Dean Morbeck, Ph.D., embryologist and director of Mayo Clinic's In Vitro Fertilization Laboratory. "The time-lapse incubator allows us to culture embryos in a very controlled environment with minimal disturbance, bringing us one step closer to what occurs naturally. We anticipate that patients who have embryos that struggle to develop in traditional incubators will benefit the most from this technology."

The time-lapse incubator incorporates a microscope, camera and computer that provide continuous images of embryos during in vitro culture. The photos provide a detailed record of how and when each cell in an embryo divides. The new technology helps fertility specialists better monitor embryo development to select the healthiest-looking embryos for implantation. Embryos not transferred that develop to the blastocyst stage, the stage at which embryos are implanted into the uterus, are frozen for later use.

Besides providing a safe, closed system for embryos to develop, the technology allows parents to view a video with a series of images from shortly after conception through the first few days of embryo development.

Mayo Clinic this month marked the births of twins, a boy and a girl, from IVF using the time-lapse incubator. It is one of a handful of hospitals in the United States that have the technology.

"Our births and the recent announcement of the first births in the United States from embryos cultured in a time-lapse incubator at the Fertility Centers of New England ushers in a new era in embryo culture," Dr. Morbeck says. The new technology, the EmbryoScope? Time-lapse System, is manufactured by Unisense? FertiliTech, based in Denmark.

Listen to the first song sent from Mars

Musician will.i.am tells the story behind "Reach for the Stars," the first song broadcast from another planet.

Hip-hop musician will.i.am's "Reach for the Stars" officially became the first song broadcast from Mars today, thanks to a signal beamed from NASA's Curiosity rover.

"This is the first time that a song's ever come from another planet," Leland Melvin, NASA's associate administrator for education and a former astronaut, told students at an educational event at the Jet Propulsion Laboratory in Pasadena, Calif.

On one level, the song's airing at JPL was as much of an audio and photo op as Monday's broadcast of a statement from NASA Administrator Charles Bolden, which represented?"the first human voice broadcast from Mars." But on another level, the blend of space exploration and pop culture fueled the already-high interest in Curiosity's $2.5 billion mission on Mars.


"Mars has always fascinated us, and the things Curiosity tells us about it will help us learn about whether or not life was possible there, and what future human explorers can expect," Bolden said in a NASA statement. "Will.i.am has provided the first song on our playlist of Mars exploration."?

Inspiring the next generation
The event was also aimed at inspiring the next generation of explorers, engineers and scientists: Among the listeners in the JPL audience were students from Boyle Heights ??the L.A. suburb where will.i.am, one of the stars of the Black Eyed Peas, grew up.

"I'm a little nervous, because my mom's in the audience," will.i.am joked. He said he wanted to inspire the kids in his old neighborhood "so that you guys don't ever think about leaving it, but changing it."

Believe it or not, this isn't the first time people tried to have a song broadcast from Mars. The European Space Agency arranged for its Beagle 2 lander to transmit a tune recorded by the British rock group Blur as the first signal confirming that spacecraft's safe landing in 2003. Unfortunately, that lander went out of contact during its descent and was never heard from again.

This time, the experiment worked.

Well after Curiosity's successful landing on Aug. 5, "Reach for the Stars" was uploaded to the rover's onboard computer and then transmitted back to NASA's Deep Space Network antennas on Earth. Flight director Bobak Ferdowsi, who has achieved Internet fame in his own right as "NASA Mohawk Guy," cued up the four-minute audio clip at the appointed time today. The rover wasn't broadcasting in real time: There's currently a nearly 15-minute communication gap for Curiosity's communications, due to the time it takes radio signals to travel the roughly 166 million miles (267 million kilometers) between Earth and Mars.

How the song got started
Will.i.am said the Mars Curiosity project had its genesis in "i.am.FIRST," an ABC-TV special on robotics and science education that he helped fund for broadcast last year. As a result of the success of that program, Bolden asked will.i.am to become involved in NASA's educational outreach program, and in response, the musician asked whether the space agency had anything special coming up.

"He said, 'We have a rocket going to Mars,'" will.i.am recalled. "So I said, 'Hey, have you ever thought about putting a song on the rocket, so when the rocket lands, the song comes back to Earth?' That's never happened before. So he said, 'Who's gonna do the song?' I said, 'Are you serious? Damn!'"

The musician said he intentionally went with an orchestral sound (with a 40-piece ensemble) instead of the usual hip-hop or dance beat. "I didn't want to do a song that was done on a computer," he said. "I wanted to show human collaboration ... and something that would be timeless, and translated in different cultures."

Will.i.am said the point of the song wasn't just about spaceflight.

"It's a reminder that anything is possible if you discipline yourself, and dedicate yourself and stand for something," he said. "Every single person that's a part of NASA stood for something, and we have this wonderful technology?? the phone you have in your hand, and small computers. If it wasn't for their discipline and their relentless research and efforts, we wouldn't have these small computers. We don't have to just end up in the 'hood. But it's a hard thing. The hardest thing is discipline. Everything else is easy."

During today's event, the musician's i.am angel Foundation and Discovery Education announced a $10 million classroom education initiative focusing on STEAM themes (science, technology, engineering, arts and mathematics). NASA said the Discovery Education initiative will incorporate content from the space agency and space exploration themes as part of its curriculum. The initiative will aim to reach 25 million students annually.

Do Sex Strikes Ever Work?

A civil rights group in Togo is urging women to participate in a weeklong sex strike to put pressure on the country?s men to urge the president to resign. Do sex strikes ever work?

Yes, but mostly as a means of garnering media attention. The Togolese group cites as its inspiration a strike organized in 2003 by a women?s peace group to encourage the end of the Second Liberian Civil War. (The effort was chronicled in the 2008 documentary Pray the Devil Back to Hell.) Women of Liberia Mass Action for Peace did force an end to the war, but their tactics were more complicated than a simple sex strike: They also staged sit-ins and mass demonstrations, which were arguably far more effective than the sex strike. Leymah Gbowee, the leader of the peace group, wrote in her memoir that the months-long sex strike

had little or no practical effect, but it was extremely valuable in getting us media attention. Until today, nearly 10 years later, whenever I talk about the Mass Action, ?What about the sex strike?? is the first question everyone asks.

Generally, sex strikes?known in activist circles as ?Lysistratic nonaction,? a nod to Aristophanes? ancient Greek comedy?appear to be more successful when the women involved have little economic autonomy, when their demands are specific and realistic, and when they possess endurance and strength in numbers. In the tiny, rural Filipino town of Dado last year, women belonging to a sewing collective successfully brought an end to violence on a thoroughfare connecting Dado and a regional market center by withholding sex from their husbands for a week. And a four-month, 300-woman sex strike in the Colombian town of Barbacoas last year succeeded, with local authorities promising to improve conditions on the roads connecting Barbacoas to the nearest town. (Compare this to a highly publicized 2006 sex strike by the girlfriends of gangsters in a violent region of Colombia, which was called off after 10 days with no indication that their demand?an end to gang violence?had been met.)

Recent sex strikes in Western countries have been unsuccessful. A call for a sex strike by a Belgian senator to end a political stalemate last year was widely reported seriously but turned out to be a joke. And a similarly tongue-in-cheek call this spring by a progressive women?s group for a sex strike in favor of reproductive rights did little to quell America?s abortion- and contraception-related political squabbling.

Yankees win terror protection, but do you lose?

Yankee fans root for a first-place team and usually watch their heroes win when they visit the new Yankee Stadium in New York. But fans of the Bronx Bombers have recently lost something too, something many sports fans around the country will probably lose soon: the right?to sue the team for damages if there's a terrorist attack.?Meanwhile,?another team?can claim victory every time the Yankees take the field -- tort reform advocates.

In July, Yankee Stadium became the first sports facility to earn the coveted federal "Safety Act" designation. That means the facility has passed a battery of tests and won approval from the Department of Homeland Security, so the Yankees have been granted a wide-ranging immunity from future lawsuits that might stem from terrorist attacks.


Dozens of defense companies have been named to the Safety Act approved list since DHS started handing out the designation in 2004. But Yankees Stadium is the first of what is expected to be many sports venues whose operators will then be immune from standard lawsuits that might be filed by future victims of terrorist attacks. (The National Football League was placed on the Safety Act list in 2008, but the designation was vague and probably only applies to the Super Bowl, experts say.)

Supporters say the Safety Act gives strong incentives for firms to raise their security standards, and encourages innovation. Opponents say it unfairly terminates a basic consumer right, makes people less safe and serves as an under-the-radar version of tort reform. As evidence, opponents point out that the Safety Act framework is being copied for many other legislative initiatives, including the failed effort to pass a comprehensive Cybersecurity Bill this year.

It's the mother of all liability waivers, says George Washington University law Professor Ellen Zavian, an expert in sports law. But the question is, do fans know about it?

"There's waivers on ticket stubs ? but I haven't seen any waivers that state, 'Oh by the way? ? we can waive (liability) for terrorism attacks.'" Zavian said. "How did this get under the radar? Are people really supportive of that? I think attendees should know what they are waiving when they enter a facility, and I don't think they do."

The Safety Act (SAFETY is actually an acronym for "Support Anti-Terrorism by Fostering Effective Technologies") was passed as part of the legislation that created the Department of Homeland Security in 2002. And that's part of the problem, argues John Bowman, director of federal relations for the American Association for Justice.

"Clearly this was done in haste after 9/11," he said. "It was a fear-driven time. There was dramatic tort reform. It's fair to say these tort reformers took advantage of that moment. ...We disagree with the way the law is structured. We think it's not very helpful for fans if something happened."

The law would clearly be helpful to the Yankees if something happened. A report by the European Organisation for Security, which is helping the European Union consider similar terrorism-related tort reform, says that $40 billion in private claims was paid out by insurers in the wake of 9/11, with billions more in claims still unsettled.?The Safety Act would prevent many such lawsuits after a future 9/11-style attack.

'A marketing edge'
But the law does much more than offer the civil equivalent of a get-out-of-jail-free card, supporters argue. Bob Karl, who operates SafetyActConsultants.com and has helped dozens of companies achieve certification, says liability protection is absolutely essential for companies deploying newfangled anti-terrorism technologies. Companies are concerned that with each new gadget they deploy, they incur new liability, he said.

Karl gave the example of a company that had invented a new radioactivity detector for cargo containers on ships. Selling the detectors would be, initially, a tiny $10 million annual business for the multibillion-dollar company, but the firm feared that if something went wrong with its product, victims could sue for the entirety of the firm's value. It makes no sense for companies to take on risk like that, and the firm didn't start selling its detectors until it achieved Safety Act designation, he said. He declined to name the firm.

"It's very real concern, and Congress had that concern when it passed the law," he said.

With Safety Act protection, companies can afford to deploy unproven or newer technologies, knowing their risks are lower, he said. That makes everyone safer.

Also, he insisted, the Office of Safety Act Implementation, which grants the certification, has very high standards, and firms become safer merely by taking on the process.

"The fear is there would be some kind of double-secret handshake and they would just hand these things out. ? Well, that's not how it happens," he said. Many applications take years before they achieve final approvals. "I had one application recently that was 5,000 pages long," Karl said.

Meanwhile, Safety Act designation can give smaller companies, "a marketing edge," he said. "It's kind of like a Good Housekeeping seal of approval."

But even Karl agrees that the Safety Act was "tort reform at a very high level." Safety Act designation makes it impossible to sue a company after a terrorist attack for standard negligence ? a ticket-holder bringing in an explosive device in a purse that wasn?t detected during standard bag inspection by entrance guards, for instance. But it also grants a host of other legal rights. Victims who wish to pursue legal action after a terrorist attack can only do so in federal court; joint and several liability (in which any involved party can be liable for an entire disaster) is eliminated, which reduces firms' exposure; and there is a ban on punitive damages on interest accumulation related to any potential judgment.?Victims cannot sue for negligence; the only way to pierce Safety Act immunity is to prove fraud during the application process, or actual malice by the company.

Another concern expressed by opponents is that the definition of a terrorist attack is left vague by the law ? essentially, a terrorist attack is anything the Department of Homeland Security calls a terrorist attack, which could include domestic terrorism, such as the Oklahoma City bombing in 1995 or even the recent Aurora, Colo., mass shooting.

One likely outcome of Safety Act protections could be lower insurance premiums for companies involved, thanks to caps on costs that could arise from a terrorist attack.

Bradley Shear, a civil litigation attorney and opponent of the Safety Act, said he didn't understand what was in it for fans.

"I think this is well intentioned, but can it equally protect businesses and the average consumer?" he said. "In return for the liability shield, what is the public getting? Are Yankees tickets going to be cheaper because they've been able to obtain Safety Act (designation)? Will the cost of a hot dog or a beer be any less?"

Or, as another opponent of the legislation said, has it just created a new consulting industry that earns millions helping companies navigate?the Safety Act application process? A quick search of Google shows there is indeed a thriving industry in Safety Act consulting.

David McWhorter, a consultant at Catalyst Partners in Washington D.C., which helped the Yankees with its Safety Act application, said critics have a misunderstanding of the approval process. Most companies are forced to raise their insurance coverage by the Office of Safety Act implementation, he said, adding that?he couldn?t think of a single case where firms were allowed to reduce their coverage. And insurance firms aren't yet offering security firms the equivalent of a "good driver discount," either.

In other words, they're not getting Safety Act coverage to save money today, he says. They do it because they become safer through the process, and because they want cost certainty.

"It's important for a facility to get a pre-emptive cap on liability," he said. "For any venue that has met the Safety Act standards, patrons can feel assured they are among the best of the best when comes to security. It?s a win-win for the public and for that venue."

McWhorter said when companies approach him for help with their application, he generally spends a lot of time consulting on how to improve the firm's security guard hiring and training processes. He also helps companies set up "red team" exercises -- mock attacks? -- to prepare them for the rigorous Homeland Security evaluation.?

"It's not inexpensive to provide security to a venue that holds 10,000 to 60,000 people," he said. "You have to consider hiring, training, exercises, cameras, alarms, mass notification systems, definition of the command structure, metal detectors, the auditing process, and so on."?

Sticking out like a sore thumb
Browsing the list of Safety Act designated technologies?on the Department of Homeland Security's website, visitors see a list of both familiar and unfamiliar names: ADT Security, Unisys and Securitas are listed alongside Massachusetts-based Ahura Scientific, for example. Many of the approved technologies are what you might expect: In March, American Science & Engineering got approval for X-Ray inspection systems; the aforementioned Ahura ? which recently changed its name to Thermo Scientific -- lists handheld devices that identify chemicals using "Raman spectroscopy."

On such a list, the Yankees stick out a bit like a sore thumb.

"New York Yankees d/b/a The New York Yankees Baseball Club provides The New York Yankees Security Program," the Safety Act office announcement says. "The Technology is a comprehensive integrated security system, which is comprised of physical and electronic security measures, tools and procedures designed to detect, deter, prevent, respond to and mitigate Acts of Terrorism at Yankee Stadium during Game Day, Non-Game Day (In-Season), Non-Season and Special Events."

One of these things is not like the other, complains Bowman.

?When you look at the law -- it's for makers and suppliers of technology," he said. "That was their intent, not to protect ballparks and give them a get-out-of-jail-free card, as long as they didn't lie ... during the approval process.?

The Yankees did not respond to a request for comment.

McWhorter says that sports venues are good candidates for Safety Act protection because they host major events that attract attention, and need incentives to go "above and beyond" standard levels of security.

"Yankee Stadium is not unlike the Cincinnati airport, the Stock Exchange, the NFL, or Super Bowl venues, all of which have received Safety Act protection," he said. "The regulations for the Safety Act are very clear that the (Department of Homeland Security) secretary has great flexibility in approving applications. Nevertheless, one criterion is, to paraphrase, 'To get Safety Act protection, you must demonstrate the need for Safety Act protection.'? The Safety Act incentivizes activities like vulnerability assessments and security upgrades, whereas without it some people might simply ignore threats in order to avoid any culpability."

Bowman said he didn't have a fundamental disagreement with the notion of encouraging invention of terrorism-fighting technologies, but feared that the Yankees designation proves the Safety Act is now casting a far wider net than originally intended. That's not a mistake, he thinks: Tort reformers try to gain more ground each time Congress takes up an industry issues or security issues, he said.

"We see this over and over in what we do. The first thing industry asks for are liability protections," he said, citing this year's cybersecurity bill as an example. "But if they are not accountable, they aren't responsible and no one is ultimately safe."

Karl, the Safety Act consultant, said he believes the Safety Act does make America safer, as all manner of security improvements are a standard part of the application process. He expects many more sports teams to apply -- and to receive -- Safety Act designation in the coming months and years, and he plans to pitch sports teams and facilities with his consulting services.

"The law is definitely working the way it's intended to," he said. "The Safety Act protects technologies that deter or respond to or mitigate a terrorist attack. ? That makes us all safer."

Can you have a ?no babies? baby shower? | BabyCenter Blog

Baby showers are all about the mom to be, and showing excitement for the baby she?s about to have. Some parts of baby showers are universal: Guests bring gifts, everyone plays (dumb) games, and a mom-to-be never, ever throws a shower for herself.

One mom in our community is having a dilemma about her upcoming shower ? she doesn?t want her sister to bring her newborn. Clynnc1 says ?My sister had a baby in the beginning of August and I will probably have my shower at the beginning of October so her son will be about 2 months old at this point. Is this too early to ask her to leave her son at home for a couple of hours? I feel like everything always has to be about her and would like it to be about me for one day. Thanks in advance for sharing your thoughts.?

Now before we jump all over her, we don?t know the backstory from this one post. It is possible that the sister is one of those types ? we all know them ? who suck up all of the limelight and attention wherever they go. I?ll agree that a baby shower, out of anywhere, should be a place where the mom-to-be can be sure she?s getting the attention. And hey ? attention feels good and is fun. So I find myself sympathetic to Clynnc1.

Except. Except that a 2 month old is way too young to be left behind, especially if the mom is breastfeeding. Except that in my experience babies at baby showers add to the fun and warmth and sense of anticipation. Except that this is her nephew, and you kind of hope she loves him and wants to spend time with him him.

So I?m not sure what advice I would give, except to say she should check in with her sister very gently and kindly, and then not be shocked if sister says that either the baby is invited or neither of them are coming.

Wild Blood trailer teases intense 3D medieval action

Gameloft has given us a little taste of their first Unreal-powered title, Wild Blood. It looks to be a no-holds-barred 3D combat game, complete with high fantasy gear and the full complement of custom abilities. Gameplay will span the gamut of melee hack-and-slash, archery for ranged combat, and more than a few explosive spells.

Of course, Gameloft isn't saying too much that isn't in the trailer, but with coins dropping out of just about every defeated enemy, I can't help but assume that in-app purchases are going to be a big part of the picture here (as is the case with most Gameloft titles). Let's just hope that at least they'll make the game free if they're going to be pushy with the microtransactions. 

Still, the the art's fantastic and the gameplay looks hectic. Who's interested? Anyone else getting a slight Infinity Blade vibe from this one?
